
Creditor Harassment and Abuse CaN Include:
- Receiving multiple calls from the same debt collector within a brief period. If your phone rings continuously for 20 or 30 minutes, it's considered harassment.
- Being told you will be imprisoned or facing threats designed to intimidate you into paying. Most people in debt aren't at risk of incarceration.
- Threats involving physical harm
- Contacting you through calls or letters during your work hours
- Calls made early in the morning or late at night
- Use of vulgar or offensive language
A few things collectors cannot do under the FDCPA are:
- Use threats of harm or obscene language to intimidate you
- Misrepresent the amount you owe
- Threaten you with criminal charges or imprisonment if you don’t pay
- Call or contact you at unsuitable times, such as during the night or early morning
- Reach out to you in inconvenient locations
- Impose unlawful interest or penalties
- Contact you at your workplace despite being asked not to
- Discuss your debt with anyone other than you or your lawyer
